This policy explains how Kansei Health handles your personal data when you use our website, app and services. We take the privacy of your information — and especially your health information — seriously, and we process it in line with the Nigeria Data Protection Act 2023 (the “data protection law”).

1. Who we are

Kansei Health is the data controller for personal data processed through our services. Kansei Health, Inc. is incorporated in Delaware, USA, with a Nigeria office at Idowu Martins Street, Victoria Island, Lagos. A Data Protection Officer is to be appointed and their contact details added here before launch.

2. Data we collect

Depending on how you use Kansei, we may collect:

• account details, such as your name, contact details and date of birth;
• health information you provide so that a clinician can care for you;
• order and delivery details;
• payment information — payments are processed by Paystack and Flutterwave, and we do not store full card numbers; and
• usage and device data generated when you use the website or app.

3. Why we process it, and our lawful basis

We process your personal data:

• to provide consultations, prescriptions and delivery — this is necessary to perform our contract with you;
• to meet our medical, pharmacy and record-keeping duties — this is necessary to comply with legal obligations;
• to keep the service safe and to improve it — this is in our legitimate interests, balanced against your rights; and
• to send you marketing — only where you have given us your consent.

Health data is sensitive personal data under Nigerian data protection law. We process it on the basis of your explicit consent and with appropriate safeguards, and only to the extent needed to provide your care.

4. Who we share it with

We share your data only where it is needed to provide the service, with:

• the doctors who treat you and the registered pharmacists who dispense your medication;
• delivery and logistics partners, so your order can reach you;
• payment processors, to take payment; and
• technology providers acting on our instructions under appropriate agreements.

We do not sell your personal data.

5. Storage, security & retention

We apply reasonable technical and organisational measures designed to protect your data against loss, misuse and unauthorised access. We keep your data only for as long as it is needed for your care and for our legal and accounting obligations. Specific retention periods are to be set with counsel before launch.

6. Cross-border transfers

Some of our cloud and partner systems may process data outside Nigeria. Where this happens, we apply safeguards intended to meet the requirements of Nigerian data protection law. Our actual data flows are to be mapped and documented with counsel before launch.

7. Your rights under Nigerian data protection law

Subject to Nigerian data protection law, you have the right to:

• access the personal data we hold about you;
• ask us to correct data that is inaccurate or incomplete;
• ask us to delete your data;
• ask us to restrict how we process it;
• ask for your data to be ported to you or another provider; and
• withdraw consent where we rely on it.
