This is starting-point drafting for a Nigerian telehealth business and is not legal advice. It must be checked against the Nigerian data protection law and the rules of NAFDAC, the Pharmacy Council of Nigeria (PCN), the MDCN and the FCCPC before it is published or relied upon.
1. About these terms
These Terms set out the agreement between you and Kansei Health when you use our website, app and services (together, “Kansei”, “we”, “us” or “our”). By creating an account, taking a quiz, or otherwise using our services, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, please do not use Kansei.
Kansei Health, Inc. is a company incorporated in Delaware, USA, and operates in Nigeria from an office at Idowu Martins Street, Victoria Island, Lagos. Where these Terms refer to local care, they refer to services delivered to people in Nigeria by Nigerian-licensed clinicians.
2. Who can use Kansei
To use Kansei you must:
- be at least 18 years old;
- be resident in Nigeria at the time you use the service; and
- have the legal capacity to enter into a binding contract.
You are responsible for keeping your account details secure and for activity that takes place under your account. Please contact us promptly if you believe your account has been used without your permission.
3. What Kansei is — and what it is not
Kansei is a telehealth platform. We connect you with Nigerian-licensed doctors and registered pharmacists for online consultations, prescriptions where clinically appropriate, and delivery of medication. We help coordinate your care; we are not a substitute for an in-person examination where one is needed.
Kansei is not an emergency service. If you are experiencing a medical emergency, or you believe your life or someone else’s life is at risk, do not use Kansei — seek immediate in-person care at the nearest hospital or contact local emergency services.
4. Consultations & prescriptions
Any treatment is provided at the independent clinical judgement of a licensed doctor. Completing a quiz, creating an account, or paying for membership does not entitle you to, or guarantee, a prescription. A clinician may decide that a treatment is not suitable for you, or may recommend an alternative or an in-person review.
So that clinicians can care for you safely, you agree to provide accurate, complete and current information about your health, medication and circumstances, and to tell us if anything changes during your care.
5. Membership & billing
Kansei membership is ₦55,000 for your first month and then ₦209,000 per month until you cancel. Medication, where it is prescribed, is billed separately from membership.
Payments are processed by our payment partners, Paystack and Flutterwave. You may cancel your membership at any time from your account; cancellation stops future billing. Cancelling does not refund the current billing period unless a refund is required by law. Prices shown are in Nigerian Naira.
6. Delivery, medicines & returns
We deliver across Lagos and Abuja and through partner clinics in 20 states. For your safety and the safety of others, prescription medicines generally cannot be returned once they have been dispatched, except where an item is defective or where the law requires otherwise. Medicines that need temperature control are shipped with appropriate cold-chain handling.
7. Acceptable use
You agree to use Kansei lawfully and in good faith. In particular, you must not give false or misleading information, share or resell medication prescribed to you, allow anyone else to use your account, attempt to disrupt or gain unauthorised access to the service, or use Kansei for any unlawful purpose.
8. Intellectual property
The Kansei name, logo, website, app and content are owned by or licensed to us and are protected by intellectual-property laws. You may use them only as needed to use the service. Medication brand names referred to on the platform are the trademarks of their respective owners.
9. Limitation of liability
To the maximum extent permitted by Nigerian law, Kansei is not liable for indirect, incidental or consequential loss arising from your use of the service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for matters that the law does not allow us to exclude.
10. Governing law & disputes
These Terms are governed by the laws of the Federal Republic of Nigeria and are subject to the jurisdiction of the Nigerian courts. The specific dispute-resolution mechanism is to be confirmed with counsel before launch.
